Terms and Conditions (GTC)

With the binding registration for events of Projekt Szenario, Wilhelm Hermsen, the participant recognizes the following conditions of participation in addition to the conditions and provisions of the individual tenders without restriction:

§ 1 Scope

1. These conditions of participation regulate the legal relationship (organization contract) that will come about between the participants and the organizer (namely Projekt Szenario, Wilhelm Hermsen). They are subject to occasional changes in content. In the version valid at the time of registration, they are part of the contract between the organizer and the participant. Changes that are made taking into account the legitimate interests of the participants and that are announced by the organizer on the Internet or in writing, become part of the contract without any further contract.

2. The contracting partner for the participants is Projekt Szenario, Wilhelm Hermsen, Wiesenstraße 14, 48465 Schüttorf

3. All declarations made by a participant to the organizer are to be sent to Projekt Szenario, Wilhelm Hermsen.

4. Events of Projekt Szenario, Wilhelm Hermsen, which are registered with the German Athletics Association, are organized according to the International Competition Regulations (IWB) of the German Athletics Association (DLV) e. V. and the International Association of Athletics Federations (IAAF). For disciplines within the registered events that are not part of the official competition program of the DLV and the IAAF (e.g. Bambini runs, team runs, relays, etc.), the respective provisions of the announcements on the event's own website apply. For events from Projekt Szenario, Wilhelm Hermsen that are not registered with a sports association, the competition regulations of the respective announcements apply (can be viewed on the event's own website).

§ 2 Conditions of Participation

1. Anyone who has reached the age specified in the respective event announcement for the selected discipline is entitled to start.

2. Bringing baby joggers, dogs, wearing earphones or listening to music is not permitted during the run.

3. Sports equipment such as hand bikes, inline skates, walking sticks, etc. are only permitted if this is stated in the event advertisement or if the project scenario, Wilhelm Hermsen, expressly approves it.

4. The organizer will notify the participants of organizational measures before the start of the event. The instructions of the organizer and his staff must be followed. In the event of violations that disrupt the proper course of the event or endanger the safety of the other participants, the organizer is entitled to exclude the person concerned from the event and / or disqualify them at any time. In these cases there is no entitlement to reimbursement of the participation fee. Legally binding declarations can only be made to the participants by the group of persons authorized to do so by the organizer, the police and the regulatory authorities. This group of people also includes the members of the medical services supervising the event, who can also prohibit the participant from participating or continuing to participate in the event in the event of corresponding signs of health in order to protect the participant.

§ 3 health

1. By registering for the respective events of Projekt Szenario, Wilhelm Hermsen, the participant confirms that he has checked his health requirements for participation on his own responsibility, possibly with the assistance of a doctor, and that he accepts the health risks from his participation.

2. The organizer reserves the right to exclude participants from the event if the health of the participant appears to be endangered.

§ 4 Registration and participation fee

1. Registration is possible up to the respective deadline, provided that any participant limits are not reached beforehand. Late registrations are possible at the increased late registrations fee, in accordance with the individual tender conditions.

2. The organizer reserves the right to set a participant limit at any time. Registrations that exceed the limit will not be accepted. If there are more registrations than starting places when the limit is set, the date of receipt of payment decides.

3. The binding registrations take place after the registration with the organizer online via the corresponding websites of the respective events and after receipt of the money for the starting place and, if necessary, additional services. Registration in any other way than the one mentioned above (telephone, fax, e-mail, etc.) is not possible, unless this is expressly permitted by Projekt Szenario, Wilhelm Hermsen.

4. The additional option of on-site registration is available in accordance with the individual tender documents - provided the participant limit has not yet been reached.

5. The following applies to group registrations and registrations of relays and teams: The registrant of the group registration or the registrant of a relay or team expressly declares that the conditions of participation are known to all participants registered by him and that they accept them without restriction.

6. With the registration, regardless of actual participation, the entry fee as well as the individually selected additional services (chip fee, merchandising etc.) are due for payment. The amount of the entry fee can be staggered and results from the respective announcement. The day of online registration is decisive for calculating the entry fee.

7. The registration is only binding when the entire organizational contribution (entry fee and any additional services booked) has been received by Projekt Szenario, Wilhelm Hermsen. If the organizer has not received the organization fee by the registration deadline, there is no right to participate and the registered additional services. Participation is then only possible as part of a late registration against payment of the increased late registration fee, provided that the participant limit has not yet been reached.

8. The right to participate is a highly personal right and is not transferable. Starting numbers are also not transferable.

9. Registrations to other people are not possible. A change of disciplines or competitions is possible, as long as this is advertised separately for the respective events.

10. Projekt Szenario, Wilhelm Hermsen can reject the registration of a participant without giving reasons. If the registration was made online and the organization fee has already been paid, it will be refunded to the participant without any deductions. The participant will be informed of the non-acceptance of the registration.

§ 5 Terms of payment and reimbursement of entry fees

1. All payments are to be made free of charge for the organizer to the account of Projekt Szenario, Wilhelm Hermsen by participating in the direct debit procedure. A German account is required for this. Foreign participants without a German bank account have the option of transferring fees. The corresponding bank details can be obtained from Projekt Szenario, Wilhelm Hermsen.

2. Costs that arise due to incorrect bank details or return debits are borne by the registrant and will be billed to the participant at a flat rate of 5.00 EUR.

3. If no online confirmation of registration can be sent (e.g. in the case of incorrect e-mail addresses), evidence of the debiting of the entry fee from the participant's account (account statement) shall be considered as confirmation of registration, which must be presented together with the identity card when collecting the starting documents.

4. If the participant withdraws or does not show up, the organization fee will not be reimbursed (entry fee and additional services). This also applies if a medical certificate is presented.

5. Should the event be canceled due to force majeure, official orders, storms (storm, flood, etc.), threats of assassination or terrorism, fire or other reasons for which the organizer is not responsible, or if the form of implementation has to be changed , there is no right to a refund or reduction of the entry fee or return of purchased items.

§ 6 data protection

1. The personal data provided by the participant when registering will be stored and processed for the purposes of carrying out and handling the events (Section 28 of the Federal Data Protection Act). This applies in particular to the data required for payment processing. If you provide an email address, communication will only take place via this communication channel.

2. The participant also agrees that the photos, film recordings, interviews made in connection with participation in the event on radio, television, print media, books, photomechanical reproductions (films, videos, etc.) etc. without claim Remuneration are disseminated and published.

3. The participant agrees that personal data will be passed on to a company commissioned by the organizer for the purpose of sending medals, photos, videos etc. of the participant on the route and at the finish line. However, the participant does not hereby declare that such a photo etc. should be purchased.

4. The participant agrees that the personal data collected may be passed on to third parties commissioned by the organizer for the purpose of timing, creating starter and result lists and posting these lists on the Internet and also stored there.

5. The participant expressly agrees to the publication of surname, first name, gender, year of birth, club, start number and result (placements and times) in all event-relevant print media (list of participants, list of results, etc.) and in all electronic media such as the Internet.

6. The participant agrees that the personal data collected will be passed on to the relevant service provider when booking an additional service, provided this is necessary for the implementation of the service.

7. The participant agrees that the stored personal data may only be used for advertising purposes by Projekt Szenario, Wilhelm Hermsen.

8. The participant is entitled to object to the disclosure of his personal data. He has to inform Wilhelm Hermsen of this in writing about the Projekt Szenario. With the objection, in particular, the possibility of entries in the starter and result list and the time measurement is omitted.

§ 7 timing

1. For events with time measurement, a time recording system is specified by Projekt Szenario, Wilhelm Hermsen (eg ChampionChip). Participants without the time recording system specified by Project Scenario, Wilhelm Hermsen will be removed from the race and disqualified by the track staff.

2. The results are presented in accordance with the guidelines of the German Athletics Association if the event has been registered with the DLV. For all other events, the separate announcement is decisive for the presentation of the results. If intermediate times are missing or measured intermediate times do not appear plausible, the organizer reserves the right to disqualify the participant.

3. If the time measurement works via a transponder / chip system, this can be borrowed when registering or, if specified separately, purchased.

4. If a row of transponders / chips is agreed when registering for the time measurement, the participant will receive this together with the starting documents at the starting documents issue. The loan chip / transponder can only be returned on the day of the event by the time specified in the respective advertisement.

5. If the rental chip / transponder is not returned undamaged on the day of the event, it will be billed to the participant. The invoice amount for this case is specified in the respective advertisements. The possibility of further use of the chip at other events is not guaranteed, even if it has been paid for.

6. If the participant has purchased their own chip between registration and the event, its number code can be added up to the registration deadline. In this case, a corresponding rental fee will not be reimbursed.

7. Chips / transponders loaned from other events will not be taken back.

§ 8 Exclusion and Disqualification

1. Participation without the chip / transponder provided for time measurement in accordance with § 7 or the justified suspicion of manipulation of the chip or time measurement (e.g. shortening on the route) will result in immediate disqualification.

2. The officially allocated start number must be clearly visible on the chest. Exceptions are possible if these are stated in the respective announcements.

3. If the start number is changed in any way, in particular the advertising imprint is invisible, made illegible, removed or carried on the back, the participant will be excluded from the time evaluation (disqualification).

4. In addition, the rules of the sports associations listed in Section 1, Paragraph 4 of the respective competitions apply.

5. Projekt Szenario, Wilhelm Hermsen reserves the right to disqualify and / or exclude a participant from the event at any time. Reasons for exclusion are, in particular, incorrect information about personal data during the registration, a ban imposed on the participant by the DLV or the IAAF, missing intermediate times in the timing, the suspicion of ingestion of unauthorized substances (doping) or if the organizer or the organization has justified acceptance authorized medical service that the participant cannot take part in the run or continue it for health reasons.

6. Even if participants should use the event as a platform for unauthorized activities or similar that damage the reputation of the organizer and / or the individual sponsors, the organizer reserves the right not to allow said persons or these participants to take part (group) to be removed from the route by the route staff. This applies in particular to unauthorized or unauthorized advertising on running jerseys / shirts for companies, institutes, associations, etc., especially if these are in competition with the sponsors of the organizer.

7. In the event of disqualification for the above reasons, there is no entitlement to a refund of the entry fee.

§ 9 Exclusion of Liability and Limitation of Liability

1. Projekt Szenario, Wilhelm Hermsen assumes no liability for health risks in the person of the participant in connection with the event. Reference is made to § 3.

2. If Projekt Szenario, Wilhelm Hermsen is entitled to make changes to the implementation of the event or to cancel it due to an official order or for security reasons, in cases of force majeure, there is no entitlement to reimbursement of the entry fee or further claims for damages. This also applies to a cancellation or change shortly before or during the event.

3. Projekt Szenario, Wilhelm Hermsen is not liable for negligently caused property damage or financial loss. Liability for personal injury caused by negligence and not by gross negligence is limited to the amount insured under the liability insurance provided by Projekt Szenario, Wilhelm Hermsen.

4. We are not liable for atypical or unforeseeable consequential damage, except in cases of willful or grossly negligent action.

5. The above limitations of liability also apply to the liability of Projekt Szenario, Wilhelm Hermsen for vicarious agents or vicarious agents, as well as to the personal liability of employees, representatives, vicarious agents and third parties that Projekt Szenario, Wilhelm Hermsen uses in connection with the implementation of the event or with whom he is contractually connected for this purpose.

6. Projekt Szenario, Wilhelm Hermsen assumes no liability for items stored free of charge. This applies in particular to events where a clothes deposit is set up.

§ 10 premiums, material prizes and entry fees

1. If Projekt Szenario, Wilhelm Hermsen awards or entry fees are advertised at an event, they will be transferred to the participant no later than four weeks after the respective event, subject to the outstanding results of the doping control and the other contractual agreements.

2. Written material prizes for award ceremonies (e.g. age class awards) will not be forwarded. The participant is not entitled to these prizes.

3. In the event of a positive doping test or disqualification, each participant loses the right to the payment or distribution of a bonus and has to return any bonuses received.

4. After the publication of the official list of results for all competitions, there will be no more changes in the placements or in the bonus payments.

§ 11 Travel

1. The combination of travel services offered to you is a running trip within the meaning of Directive (EU) 2015/2302. You can therefore benefit from all EU rights that apply to package tours. The company bears full responsibility for the proper implementation of the entire running trip. Further information on your most important rights under Directive (EU) 2015/2302.

2. Most important rights under Directive (EU) 2015/2302

3. Should individual provisions of these conditions of participation be ineffective or should gaps emerge in the set of rules, the effectiveness of the remaining provisions will not be affected.
